Payment of Subscription 1.1 The annual subscription shall be payable by Full Members, Vice Presidents, Social Members and Junior Members at the rate set by the Club Board. 1.2 The annual subscription, for non-playing members shall be payable from 1st July and, in any event, by 30 September in each year. Playing members (full and junior) shall register and pay their subscription on Club designated registration dates. Non-payment will render playing members ineligible for matches and use of Club facilities. 1.3 The Membership Secretary, following consultation with the prospective Member and the relevant Team Captain, has the power to calculate, pro rata, the subscription payable for any Member who is admitted after 31 October in any year. 1.4 Where payment is made in instalments, the subscription must be paid monthly in accordance with any agreement entered into and calculated in accordance with the appropriate rate. 1.5 Should a Member, by agreement with the delegated person responsible (as approved by the Business Committee), be granted permission to pay his/her annual subscription by way of instalment payments and should he/she thereafter default in any one payment and remain in default thirty days after due date of such instalment or resign his/her membership, then he/she shall be liable to pay immediately the full balance outstanding of his/her annual subscription together with any other charges incurred in obtaining the instalment facility and, if in default as indicated above, the Business Committee may terminate such Member’s membership. 1.6 Where payment is to be made by instalments then, subject to the delegated person responsible’s consent, all payments must be made in accordance with the agreed payment schedule. Any dispute will be heard by the Business Committee. 2. Guests 2.1 Members may introduce and entertain guests at the Club. Members introducing guests shall be responsible for the conduct of their guest (s) and for ensuring that their guest(s) strictly observing the Club Rules and Regulations. Members must ensure that they do not leave the Club prior to their guest(s). The Business Committee may suspend any Member whose guest(s) do not observe the Club Rules and Regulations or whose conduct adversely impacts on the use and enjoyment of the premises by other members and/or guests. No person whose membership has been terminated or whose application for membership of the Club has ever been rejected shall at any time be introduced as a guest. 3. Addresses of Members and Notices 3.1 Each Member shall inform the Membership Secretary of his/her address or change of address. Notices required by these Rules and Regulations to be given to Members may be given either by pre-paid letter addressed to a Member at the last address he/she furnished to the Membership Secretary, by email to the last email address he/she furnished to the Membership Secretary or by exhibiting such a notice in a prominent place on the Club’s notice board and on the Club’s website. 4. Tournaments and Exhibitions 4.1 On the occasion of an organised tournaments or exhibitions, persons invited by the Club Board of Directors, persons accompanying them and bona fide spectators may be admitted to the privileges of day membership for those occasions provided that: a. no person admitted to the Club by virtue of this Rule shall be entitled to take part in the management of the Club nor shall they be able to introduce guests; b. persons admitted to the Club under this Rule shall be subject to the same Rules and Regulations as Members of the Club; c. such organised tournament or exhibition shall be sanctioned by the Club Board of Directors. 5. Intoxicating Liquor 5.1 The sale or supply of intoxicating Liquor in the Club shall be permitted within the general licensing hours approved by Tonbridge and Malling Borough Council (TMBC) and the bar opening hours shall be fixed by the Business Committee and ratified by the Club Board of Directors. Intoxicating Liquor shall be sold only in accordance with the terms and conditions (if any) imposed by Licensing and Appeals Committee of TMBC granted in respect of the Club premises. 5.2 The Club Board shall delegate to the Director of Business responsibility for the appointment of a Bar Manager. This employee will be responsible for the purchase and sale of alcohol for the Club. The Bar Manager will be responsible for ensuring the Club’s adherence to the requirements of the Licensing Acts. 6. Selection 6.1 The Selection Sub-Committee shall strictly comprise of the Team Captains and Team Manager (s) Team Coach, whichever is applicable and by agreement of the Director of Rugby. The Committee may also invite any other person to provide advice where it is considered their input may be appropriate. The Selection Sub-Committee shall be overseen by the Director of Rugby, with delegation passed to Chair of Selection appointed by the Director of Rugby. The Director of Rugby will be responsible for ensuring that selection procedures are overseen so as to ensure only qualified Club members are selected and that no Club member is treated in any detrimental manner. 6.2 The Selection Sub-Committee shall convene each Tuesday evening and again on Thursday evening to finalise team selection. 6.3 The determination of the Club’s overall selection policy shall be the responsibility of the Playing Committee but subject to overall scrutiny for governance by the Executive Committee and the Selection Sub-Committee shall be responsible for the implementation of that policy and for individual selection decisions. 6.4 The general selection policy shall be that the best XVs available be selected. Non-availability in one week will NOT automatically result in demotion in the next week, as levels of non-availability will necessarily influence the selection process. 6.5 Only paid-up Members shall be selected. No player, not having completed payment, or made an agreement in regard to such with the Membership Secretary by the end of September, will be considered for selection. 7. Vice Captains 7.1 The Team Captains may appoint Vice Captains who will stand as full Deputies for the Team Captains in their absence. 8. Loss or Damage to Property 8.1 All lost property on the premises shall be handed into the Bar Manager. Lost property will be disposed of after one month. 8.2 The Club’s liability for damage or lost Members’ property is strictly limited to any damage or loss suffered as a result of the negligence of the Club, its staff or its agents. With this exception, the Club will not accept liability for the safety of Members’ personal property brought on to the Club site unless these are handed in to the Bar Manager for safe keeping and a signed receipt is given. Property left in the changing rooms is left at the owner’s risk and no liability will be accepted by the Club. Cars parked in the Club car park or elsewhere on the premises of the Club and all contents in them, are left on the site of the Club at the owner’s risk and the Club will accept no liability whatsoever in respect of them. 9. Alterations to the Constitution 9.1 Alterations to the Club’s Constitution may only be made by consent of the majority of eligible voting members at an Annual or Special General Meeting, and such proposals must be notified to the Club Secretary at least fourteen (14) days in advance of such a meeting. 10. Alteration of Rules and Regulations 10.1 The Club Board of Directors may from time to time revoke, vary, add to or alter the Rules and Regulations of the Club. 10.2 The Club Board of Directors shall be the sole authority for interpreting the Rules and Regulations or any Byelaws settling all disputes relating to the affairs of the Club and the conduct of Members or temporary Members.
