This letter also includes important information on the RFU insurance programmes. Revenue funding Revenue funding for season 2008/09 will be provided to Clubs, as appropriate, under three headings as described below. i)Insurance scheme As last season, the RFU will provide and fund for all Clubs a comprehensive personal accident and liability insurance scheme. Clubs are therefore not required to declare their number of teams or pay insurance premiums. Please refer to the relevant competitions regulations for details regarding eligibility for these amounts. Travel allowance payments are available for round trip travel distances in excess of 150 miles, according to the following table. In addition to the above, Clubs will receive assistance for the knock-out cups for travel distances in excess of 150 miles in accordance with the table above. Clubs should note that these payments will be calculated automatically by the Tournament and Competitions department of the RFU for each round and payment forwarded to each Club as appropriate; Clubs do not need to submit an invoice for these amounts. Capital funding - Rugby Football Foundation Further funds are available to all Clubs, upon application, to assist specific capital improvement projects, in the form of grants up to 6,000 and interest free loans up to 100,000. Taxation Clubs should note the important points below regarding taxation. Corporation tax All financial support payments to Clubs by the RFU are subject to corporation tax in the hands of each Club. These payments should be included as trading income in the tax computation of your Club against which you may, of course, claim trading expenses or, where appropriate, trading losses brought forward. You should be aware that the RFU is required to advise HM Revenue & Customs of all payments made to each Club. VAT The RFU has confirmed that the payments in support of league rugby and payments to alleviate the costs of long distance travel are outside the scope of VAT. However, customs have ruled that payments in respect of knock-out competitions will be subject to VAT and the appropriate VAT invoicing system has been established as detailed above. Important developments regarding insurance There have been a number of changes to the RFU Personal Accident scheme and other developments which impact insurance, as described below. RFU support for Catastrophically Injured Players The letter under my name of 28 July 2008 explains how we are making significant improvements to the way in which the RFU supports catastrophically injured (CI) players. Please refer to that letter for details. In summary the new approach of the RFU will be as follows: Adopting a hands on case management based approach that provides much more direct support to the player and is flexible and responsive to each players unique needs. Creating a new trust fund whose sole purpose is providing comprehensive and co-ordinated support to CI players. Providing significantly increased personnel resources via the new trust. Basing our approach on meeting the unmet needs (financial and care) of each player Broadening the scope of cover and benefit entitlement. Providing a combination of fixed cash sums together with a flexible care benefit package, based on an assessment of each players needs. Immediate access to cash and care benefits. Maintaining long-term support for CI players, beyond the immediate period of their injury and the payment of the insurance sum. Please note that, as before, the maximum benefit payable remains at 500,000 and that other benefits under the RFU Personal Accident scheme are unchanged. Vicarious Liability re the Redruth Case There has been a great deal of interest and concern generated by the recent Court of Appeal ruling that it was 'fair and just' to hold Redruth Rugby Club responsible for the actions of one their players, whose punch in the course of play left an opponent with a broken eye socket. The RFU has discussed this case we our professional advisors and the note in Appendix I contains comments relevant to our clubs. Experimental Law Variations As you will be aware a number of Experimental Law Variations (ELVs) are being trialled throughout the world in 2008/09. Clubs are covered by player insurance provided they are playing in accordance with the laws of the game as laid down by the IRB (including ELVs) with any variations thereto as approved by the RFU. Clubs playing matches under the jurisdiction of other Unions are covered by RFU player insurance if they are playing in accordance with the laws of the game (as above), or any variations thereto that are approved by the host Union. This also covers games played in England but in a competition under the jurisdiction of another Union. Before playing a team from another union at U19 level (or below) clarification should be sought as to any variations to the laws which will apply. Although this has been reported as a landmark ruling, the concept of vicarious liability is certainly not new. Vicarious liability is when an employer is considered responsible for an act committed by an employee during the normal course of employment. What the Redruth case does do, however, is highlight a number of issues that clubs would do well to consider when making decisions and policies. 1)Do you wish to pay players? Whereas the trial judge considered Redruth not vicariously liable because the player was only semi-professional and this was a non profit making community sports club, the Court of Appeal did not agree. In addition, although in the Redruth case the player responsible for the injury was employed by the Club as a part-time employee, you should note that a club can still be vicariously liable for the actions of players it does not employ in a formal sense but whom for example it pays to play. Where a player is paid to play and where they are subject to the control of a club they can still be "deemed" to be employees of the club for the purposes of assessing whether the club is vicariously liable for the player's actions. The acts of true amateurs, on the other hand, are still unlikely to render the club vicariously liable. 2)Do you make all your coaches and players aware that any deliberate wrongdoing is likely to have wide ranging consequences? It is crucial to hammer home the message that not only is deliberate wrongdoing contrary to the Laws of the game, it is also liable to cost the player dear, the club dear, damage the reputation of the game and bring financial implications which could destroy your club. If your club is judged to have condoned a deliberate act of violence you may not be insured. So if your coach told a player, Take number 10 out in any way you have to! he could be rendering your public liability insurance invalid. Deliberate acts are excluded from the public liability insurance provided by the RFU for Clubs at Level 3 and below and so a player guilty of a deliberate act of violence would be uninsured. 3)Is your club incorporated? In an action against your club the court will determine who at the club is liable to pay any damages. It could be the Committee or certain officials who would be personally liable.
